Welcome to Market Direct Capital (“MDC,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, forms, informational resources, and related services (collectively, the “Services”). By using the Services, you agree to these Terms.

1) Eligibility

You must be at least 18 years old and authorized to act for the business you represent. Your use of the Services must comply with applicable laws and regulations.

2) What we do (and what we don’t)

MDC provides packaging, positioning, and lender-matching support for small-business financing, including SBA programs (e.g., 7(a), CDC/504, Express) and other products such as USDA B&I, bridge options, and planning services. We are not a bank, CDC, or government agency, and we do not make credit decisions. Nothing on this site is legal, tax, or accounting advice; please consult your advisors.

3) Submissions & accuracy

You may submit information through our forms (e.g., quote, contact, referrals) to be contacted about financing options. You represent that all information you provide is complete and accurate to the best of your knowledge and that you have the right to share it. Lenders may rely on your information when evaluating requests.

4) No guarantees

Financing is subject to lender guidelines, credit approval, program availability, and third-party reports (e.g., appraisal, environmental). Timelines are estimates only and can change.

5) Fees & third-party costs

Some transactions may involve third-party or lender fees (for example, reports or closing costs). We disclose our role and any applicable fees where required by law or agreement. You will not be charged simply for viewing this website.

6) Communications consent

By submitting a form, you consent to receive calls, emails, and texts from MDC or lending partners regarding your request. Message/data rates may apply. You can opt out at any time by following the instructions in our messages.

7) Privacy

Your use of the Services is also governed by our Privacy Policy, which explains what we collect and how we use it.

8) Intellectual property

The site design, text, graphics, logos, and other content are owned by MDC or our licensors and are protected by law. You may not copy, modify, distribute, or create derivative works without our prior written consent.

9) Acceptable use

Do not misuse the Services. Prohibited activities include: attempting to breach security, scraping or harvesting data without permission, interfering with site operation, or using the Services for unlawful or misleading purposes.

10) Third-party links & partners

We may link to third-party sites or work with third-party lenders and service providers. We are not responsible for their content, practices, or decisions.

11) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

12) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MDC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

13) Indemnification

You agree to defend, indemnify, and hold harmless MDC from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your submissions, or your violation of these Terms.

14) Changes to the Services or Terms

We may update the Services and these Terms from time to time. If we make material changes, we will post the updated Terms with a new “Effective date” above. Continued use after changes means you accept the updated Terms.

15) Governing law

These Terms are governed by the laws of the state where MDC is organized, without regard to conflict-of-law rules. Venue and jurisdiction will lie in appropriate courts located there.

16) Severability & entire agreement

If any provision is held unenforceable, the remaining provisions will continue in full force. These Terms, together with any written agreement you sign with us, form the entire agreement regarding the Services.
